ATTORNEY FEES AGREEMENT
Article 51 of the French law nº2015-990 of August 6th 2015 for the economic growth and the equal economic opportunities (called: the MACRON regulation) which modifies article 10 of the French law nº 71-1130 of December 31th 1971, states that a written legal fees agreement shall be signed between the Attorney and its client.
DETERMINATION OF THE LEGAL FEES
The fixing of the legal fees shall comply with the requirements established in article 10 of the French law nº 71-1130 of December 31th 1971 and article 11.2 of the National Internal Regulation Act of the French Lawyer Profession, which are:
- The working hours needed for the case.
- The legal speciality and the difficulties of the case.
- The importance of the interests concerned.
- The importance of the costs of the law firm.
- The reputation of the lawyer, titles/ experience, speciality.
- The advantages and results obtained for the client/service provided.
The Legal fees are established either:
- according to the hourly rate basis of the lawyer,
- or according to a flat fee corresponding to each legal process,
- or according to a flat fee complemented by a success fee, if applicable.
DISPUTE
If a dispute over the amount of the fees should arise that cannot be resolved amicably, the President of the DAX Bar Association sets the fees at the request of one the parties.
The client is also informed that in accordance with article L. 152-1 of the French Consumer code, it may ask to the following Consumer ombudsperson (who works in French and in English) to solve the dispute:
